I refer to your request dated 12 May 2025 regarding “a copy of a fabricated police/Crown Office report purporting to relate to me” (FOI 25-26/009) which we have handled under the Freedom of Information (Scotland) Act (FOISA).
Specifically, you asked if GTC Scotland either provided or withheld this record from Disclosure Scotland. Please note that, under section 38(1)(a) of FOISA, information is exempt from disclosure if it constitutes the personal data of which the requester is the data subject. As such, we have applied this section of FOISA to your request as the legislation does not allow for individuals to request their personal data under this Act. This is an absolute exemption and we are not required to carry out a public interest test.
