In order to demonstrate that GTC Scotland has indeed sought advice from an appropriately independent body (such as the Scottish Information Commissioner), and taken appropriate action on that advice, please could you provide copies of all correspondence seeking advice on this issue, and all responses received.

I refer to your request for information (FOI 24-25/02) dated 3 April 2024 related to publishing internal review responses on the Disclosure Log of the General Teaching Council for Scotland which we have handled under the Freedom of Information (Scotland) Act. 

In your request you asked for correspondence of advice sought on the publication of internal review responses by the General Teaching Council for Scotland on its website via the Disclosure Log.  

I can advise you that we have not sought advice from an independent body on the non-publication of internal review responses on the Disclosure Log in the 38 working days between our previous response (FOI 23-24/82) and this request. I have therefore applied section 17(1)(b) of FOISA as the information is not held. 

If you are dissatisfied with this response, you may contact informationgovernance@gtcs.org.uk to request GTCS conduct a review of this decision. You should describe the original request and explain your grounds of review. You have 40 working days from receipt of this decision to submit a review request. When the review process has been completed, if you are still dissatisfied, you may use the Scottish Information Commissioner's guidance on making an appeal to make an appeal to the Commissioner.
