How many FtT referrals have been made in the last five years, and how many have actually been concluded?

To date, what is the total amount of money spent by GTCS on legal fees etc. in the [named] referral?

How many FtT referrals have been rejected, citing the self-imposed Threshold Policy get-out clause absolving GTCS from intervening in “disciplinary issues”?

How much has FtT cost since its foundation?

Response

How many FtT referrals have been made in the last five years, and how many have actually been concluded?

Between 17 October 2020 and 17 October 2025, we received 967 conduct referrals.

Of those 967, a total of 782 cases have been concluded. 185 cases remain active.

To date, what is the total amount of money spent by GTCS on legal fees etc in the [identified individual] referral?

As at 30 October 2025, GTC Scotland had spent £2000 on legal fees in the case.

How many FtT referrals have been rejected, citing the self-imposed Threshold Policy get-out clause absolving GTCS from intervening in “disciplinary issues”?

Please note that we do not record the information you have requested in a way that we can answer without incurring fees under FOISA. While we do consider the Threshold Policy in every referral, we do not record its application in a spreadsheet which would enable us to easily answer your query.

To answer your question, we would need to revisit every case in the last five years that was closed at the initial consideration stage. Of the 967 cases mentioned above, 495 cases were screened out at the initial consideration stage. We would need to review all 495 cases in ascertain why no further action was taken and if we considered it not to meet the Threshold Policy to be a disciplinary issue “best dealt with by an employer” as suggested in your clarification.

At ten minutes per record and £15 per hour, we estimate this work to require 82.5 hours and cost £1,237.50. As this is over £600, we are not obligated to comply with this request under section 12 of FOISA and have applied it to this query.

By way of advice and assistance, if you were to narrow this request to one year then this would decrease the scope and would bring it within the Fees Regulations.

How much has FtT cost since its foundation?

Please note that while we do hold records related to your request beyond 2019/20, we retain financial documents in line with our retention schedule, and we may no longer hold some information. For all information beyond 2019/20, we have applied s12 of FOISA to this this query as answering it would exceed £600.

However, we have provided information from 2019/20 in Table 1 below. This is based on the registration year for GTC Scotland which runs from April to March of the following year.

Table 1: Total expenditure by GTC Scotland on the Fitness to teach function as per the relevant Registration Year since 2019/2020

The above figures have included FtT expenditure and staff cost.
