How many GTCS defined "member of the public" referrals to GTCS under Fitness to teach referrals actually came from:
a. School Headteachers or depute heads.
b. From PTs or Faculty/Department Heads
c. From teachers.
d. From PSAs or other school support staff.
Please provide figures for 2019-2022.
Response
We hold the following information in response to your request. We record these figures by financial year, not calendar year. Between 2019 and 2025, we received the following number of referrals from colleagues, recorded under the following categories:
a. 0 From School Headteachers or depute heads.
b. 3 From PTs or Faculty/Department Heads (all between 01 April 2023 and 13 October 2025)
c. 6 From teachers. (2 between 01 April 2019 and 31 2023, 4 between 01 April 2023 and 13 October 2025)
d. 0 From PSAs or other school support staff.
We have provided some further context on these numbers below, which we think may be of assistance to you.
Years 2019 to 2023
Between 1 April 2019 and 31 March 2023 we received 217 conduct referrals from members of the public. Of those 217, 2 referrals have been categorised as having come from ‘Member of the Public – Colleague’. Both of these referrals are from fellow teachers or a fellow teacher.
2023 Onwards
Between 1 April 2023 and 1 April 2025, we received 160 conduct referrals from members of the public. Of these 160, 12 cases are specifically noted as having come from ‘Member of the Public – Colleague.’
As above, however, these are only characterised as such if the relationship between the subject of the referral and the referrer is obvious from the referral.
3 of the 12 referrals were made by PTs.
4 of the 12 referrals were made by teachers.
The remaining 5 referrals are harder to categorise.
2 were made by Early Years Practitioners.
2 were made anonymously with not enough information to confirm their exact roles.
1 was made by a colleague, but with not enough information to ascertain their role.
Advice and Assistance
By way of advice and assistance, these referrals are only characterised as having come from colleagues if it’s obvious from the referral. Given the low number over the long period of time, there may have been other referrals from colleagues which were not blatantly obvious or were mischaracterised. In order to take steps to seek to provide confirmation in relation to this matter, we would need to check the remaining 215 records. This would require GTC Scotland to incur costs that would exceed £100. Please note that we cannot be certain what the output of this process would be. It is possible that there were only two referrals between 1 April 2019 and 31 March 2023.
Section 12(1) of FOISA provides that a Scottish public authority is not obliged to comply with a request for information if the authority estimates that the cost of complying with the request would exceed a prescribed limit of £600. It also enables us to charge for dealing with an information request if the cost of doing so exceeds £100 (at 10% of the marginal cost over and above the £100 up to the prescribed limit of £600, i.e. a maximum of £50). It does not require us to deal with a request at all if the cost of doing so exceeds £600.
We have estimated the cost of dealing with this part of your request would be £537.50. This projected costing has been produced in accordance with the Freedom of Information (Fees for Required Disclosure) (Scotland) Regulations 2004. Further information about how we have prepared this projected costing is provided in the Fees Notice below.
