By accessing any GTC Scotland Content, you are agreeing to these terms and conditions.

This page sets out the terms and conditions on which you may use MyGTCS, GTC Scotland websites and the content/services available on them (which we call “GTC Scotland Content”) irrespective of the delivery platform or device you use to access them. These terms and conditions replace all previous terms and conditions related to GTC Scotland Content. We may update these terms and conditions from time to time. Any changes will become effective as soon as we post them on www.gtcs.org.uk

These terms and conditions will be governed by and construed in accordance with Scots law and the parties submit to the exclusive jurisdiction of the Scottish courts.

These terms and conditions constitute the entire agreement between you and GTC Scotland relating to your use of our websites, online services and GTC Scotland Content: they govern the contract between you and us to the exclusion of all other terms and conditions and supersede all prior agreements and arrangements.

If any provision of these terms and conditions is found to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions, which will remain in full force and effect.

Failure by either party to exercise any right or remedy under these terms and conditions does not constitute a waiver of that right or remedy. Headings in these terms and conditions are for convenience only and will have no legal meaning or effect.

MyGTCS

Registration

Register on our website to receive Teaching Scotland magazine or to sign up for our MyGTCS service (through which we provide a range of online services, primarily for GTC Scotland registered teachers and college lecturers and that are related to professional learning).

When you register for MyGTCS, you must provide us with accurate, complete registration information and it is your responsibility to update and maintain changes to that information on the applicable pages. We are entitled to rely on any information you provide to us. View our Privacy Policy for more information.

Each registration for MyGTCS is for a single user only. On registration, you will choose a password that will be used with your email address to enable you to log-on (“ID”).

You are responsible for preventing unauthorised use of your ID. If you believe there has been any breach of security (such as the disclosure, theft or unauthorised use of your ID) you must notify us immediately. 

Cancellation

We reserve the right to suspend or terminate your MyGTCS access if you breach these terms and conditions (without notice).

User-generated content

GTC Scotland Content includes comments sections, blogs and other interactive features (we call these “Forums”). We call the information posted to these Forums by users “User Generated Content” or “UGC” for short.

You will retain ownership of the copyright in any of your UGC that you or we publish so you are free to re-use it as you wish.

You agree that if you post UGC to a Forum then you are granting us a right (but not an obligation) unlimited in time to publish, re-use, archive, modify or delete in whole or in part as we see fit, whether on GTC Scotland websites or otherwise, without any requirement to pay you for this and with or without attribution to you.

This means that you grant us a worldwide, non-exclusive, perpetual, irrevocable, royalty-free licence to use any UGC you publish in whole or in part in any manner and for any purpose whatsoever and without further obligation to you. You also waive any moral rights that you may have in regard to the UGC.

We welcome your contributions to our websites. In order to keep the experience a positive one for all our website visitors you agree that you are responsible for the content of your UGC and that you will:

  • only publish UGC that is yours and that does not infringe the copyright or other rights of a third party.
  • not post, link to or otherwise publish UGC containing advertising/promotion for goods and services or any spam or other form of unsolicited communication.
  • not post, link to or otherwise publish UGC that is threatening, offensive, indecent or otherwise unlawful.
  • not post comments that are discriminatory (e.g. which make attacks on the grounds of race, religion, sex, gender, sexual orientation, disability or age).
  • not post or transmit UGC that contains software viruses, files or code designed to interrupt, destroy or limit the functionality of GTC Scotland websites or similar.

You are financially responsible to us for any claim made against us by a third party related to your UGC.

The Forums contain UGC submitted by users over whom we have no control so we cannot take responsibility for what they post. Some users may not behave properly and may post UGC that is inaccurate or offensive.

The views expressed in UGC will not necessarily reflect those of GTC Scotland. It is not possible for us to monitor all UGC published on our websites but where we have received notice of any UGC that is potentially in breach of these terms and conditions, we will review that UGC and act accordingly.

If you believe that any UGC published on our websites infringes any legal rights that you may have or breaches these terms and conditions, please report this using the “Report Abuse” button on the relevant web page or by emailing:

Third Party Sites

Our websites may contain links to other internet websites or online and mobile services provided by independent third parties (what we call “Third Party Sites”) as well as advertising. We are not responsible for Third Party Sites or adverts and accept no responsibility for them.

Limitations

Whilst every effort has been made to develop our websites (and related online services) with reasonable skill and care, please note that the information provided is for your general information only and is not intended to address your particular requirements: it does not constitute legal or other professional advice.

Copyright and Content ownership

All GTC Scotland Content belongs to GTC Scotland or its licensors who own all intellectual property rights in the GTC Scotland Content and any selection or arrangement of the GTC Scotland Content. No intellectual property rights in any GTC Scotland Content are transferred to you.

Third Party Site content (including the Education Source package and the Leadership & Management Learning Centre to which access is provided through MyGTCS) will be subject to the copyright policy specified by the relevant site owner and you should refer to them for information about this.

You are permitted to use and reproduce GTC Scotland Content provided that you do so fairly, non-commercially and acknowledge us as the source where you supply the information to others.

Advertisements

GTC Scotland does not endorse any goods or services advertised on its website, digital publications or through any of its platforms, nor any claims or representations made in any advertisement or webinar hosted by GTC Scotland and accepts no liability to any person for loss or damage suffered as a consequence of their responding to, or placing reliance upon, any claim or representation made in any advertisement or webinar advertised on its digital publications or hosted on its website or platforms.

Readers, viewers and webinar attendees should make appropriate enquiries and satisfy themselves before responding to any advertisement or webinar, or placing reliance upon any such claim or representation. By so responding, or placing reliance, readers, viewers and attendees accept that they do so at their own risk.
