Fitness to Teach Hearings

Hearing notices will be added here up to 7 days in advance. Hearings are held at our offices or using Microsoft Teams. They are usually open to the public and media.

The name of the teacher and any witnesses will be kept anonymous in hearing notices and will not be shared with the public or press.

Upcoming hearings

Subsequent Registration Application (SRA) Hearing: 5 March 2024

Dates of hearing: 5 March 2024
Location: Virtual (via Microsoft Teams)

A Subsequent Registration Application Hearing is to be held under Part 4 of the Fitness to Teach Rules 2017 (‘the Rules’) to consider an application for registration in Primary Education subsequent to a decision of theFitness to Teach Panel in 2017 that the Applicant be removed from the GTC Scotland Register.

Following an order by a Panel, this hearing will take place virtually, by way of Microsoft Teams.

Attending the hearing

Should any members of the public or press wish to attend the hearing (virtually), they must contact GTCS no less than 48 working hours prior to the start time of the hearing (i.e. by 10.00 am on Friday 1 March 2024) in order to request the link to the public hearing. Any requests to attend the hearing beyond this time cannot be facilitated and will not be responded to. Attendees will require to have the Microsoft Teams application downloaded to their device. You can download Microsoft Teams from the Microsoft website, here, or from the Apple Store on Apple devices, or the Google Play Store on Android devices.

When requesting a link to the public hearing, please provide the following information to businesssupport@gtcs.org.uk:

  • Your full name
  • Date of hearing
  • Email address to which we can send the Microsoft Teams link
  • Contact number we can reach you on if there are any technical issues during the hearing
  • Reason for wishing to observe (for example: press)

As with hearings held in our office, members of the public and press in attendance are reminded not to interrupt proceedings and it is strictly prohibited for an observer to audio or video record, screen shot, photograph, copy or share our hearing proceedings. Under Rule 1.7.10, a Panel may decide to exclude any person where the Panel is of the opinion that his/her presence is disruptive or otherwise detrimental to proceedings being conducted in line with the general objectives. Furthermore, members of the public and press will not be permitted access to the private discussions of the Panel.

Full Hearing (Conduct): 4, 5, 7, 11-15, 18-20 March 2024

Allegations

1. Between October 2018 and April 2019 whilst employed by Edinburgh City Council [redacted], in respect of Pupil A [redacted], the Teacher did:

a) in or around October 2018, grab an iPad from Pupil A’s hands;

b) on 9 or 10 January 2019:

i. say to him, ‘looks like someone can’t read’ or words to that effect;

ii. shout at him in an aggressive and intimidating manner;

iii. force him to stand up in front of the class and read out loud as a punishment;

iv. say to him ‘you are not a good reader’ or words to that effect.

c) on 22 January 2019 call him to the front of the class whilst giving another pupil into trouble

and act in an intimidating and aggressive manner;

d) on an occasion between 14 and 22 March 2019 say to him ‘why are you speaking, you’re

the one who can’t read in this class’, or words to that effect, in the presence of other pupils;

e) mock him in the presence of other pupils by asking other pupils, ‘is this your best work, are

you Pupil A?’;

f) on numerous occasions and in particular on 14 March 2019;

i. call him a liar;

ii. say to him, ‘don’t you get smart with me’ or words to that effect in an aggressive and

intimidating manner;

g) on 22 March 2019 behave in an aggressive and intimidating manner towards him regarding his school work.

2. The Teacher’s actions at allegation 1. resulted in Pupil A:

a) being distressed;

b) expressing suicidal thoughts;

c) ultimately attending school on a part time basis.

3. In or around June 2019, whilst employed by Edinburgh City Council [redacted], the Teacher did:

a) act in an aggressive manner towards Pupil B, causing him to run out of the classroom in

distress;

b) act in an aggressive and unprofessional manner towards Parent B.

4. On or around 8 February 2017, whilst employed by Edinburgh City Council [redacted], the Teacher did act in an aggressive manner towards Parent C and did shout at her in the [redacted] playground.

And in light of the above, it is alleged that the Teacher’s fitness to teach is impaired and he is unfit to teach, as a result of breaching Parts 1.2, 1.3, 1.4, 1.6, 2.3, 4.2 and 4.4 of the General Teaching Council for Scotland’s Code of Professionalism and Conduct 2012.

How to attend a hearing
