Hearings have not been required for any temporary restriction order application over the last two years and all applications were granted. Most teachers consent to a temporary restriction order being imposed.

Appeals and reviews

A teacher can appeal against decisions made by our panels to refuse or remove registration. They must lodge their appeal within 28 days of the decision to the Court of Session. The court may decide that there are exceptional circumstances to justify extending that time period. All decisions can also be subject to judicial review.

Between 1 April 2018 and 31 March 2023, five appeals and two judicial reviews have been lodged in relation to panel decisions – all by teachers. Of these, four were upheld/ successful and three were dismissed/ unsuccessful. We always learn from appeals and judicial reviews and use this to continuously improve how we do things.

While the number of appeals and judicial reviews lodged remains low, we have experienced a marked increase in this kind of litigation since 2017 with a total of nine appeals and judicial reviews lodged in that time. We have also taken forward 13 cases to secure the recovery of documents from Police Scotland. To put these figures in context, between 1979 and 2017 (38 years) GTC Scotland was involved in a total of 17 cases, so this increased litigation has had an impact on our work.

Restoration to the Register

A teacher removed from the Register by a panel can apply to be re-registered after the period of time specified by the panel in their decision. We call this a subsequent registration application.

Before they can rejoin the Register, they must satisfy a panel at a hearing that they are fit to teach.

We don’t receive many of these applications. Between 1 April 2018 and 31 March 2023 we received 18 subsequent registration applications. Three of these applications were withdrawn; eight applications were accepted; four were refused; and three were still pending at 31 March 2023. These cases took seven months on average to conclude.

Conditional Registration Order Reviews

Where a conditional registration order is placed on a teacher’s registration by a Fitness to Teach Panel, the teacher can apply for the condition to be reviewed and revised. We received five of these applications between 1 April 2018 and 31 March 2023. Four of these applications required a hearing and one was determined at a panel meeting. The outcomes in three of the cases were that the conditional registration order was amended – in the other two cases the conditional registration order remained in place in its original terms.
