Introduction

We may restrict an individual’s registration pending the conclusion of an investigation into any circumstances which, on the face of it, might cause us to remove the individual’s name from the Register1.

In practical terms, the restriction of an individual’s registration is achieved by imposing a Temporary Restriction Order (a ‘TRO’). Unless consented to by the teacher, TROs are determined by Fitness to Teach panels. A Fitness to Teach panel (‘a panel’) comprises a majority of teachers and at least one lay person2. The effect of a TRO is explained further below.

In the interests of consistency and transparency, this practice statement provides further guidance about the procedure and the factors relevant to whether or not a TRO should be imposed. This guidance is not intended to be exhaustive or prescriptive as to the factors that may need to be considered. However, it is a useful starting point for panels to ensure a general consistency of approach. It is also intended to assist other participants involved in TRO proceedings to understand the process.
