Fitness to Teach (Complaints) Panel Schedule and Decisions

Fitness to Teach Hearings are generally held in public and information about the cases to be heard is published no more than 7 days in advance. You can view forthcoming Hearings by clicking on highlighted dates on the Hearings calendar.

We also publish details of the hearing day start time but please note that we are unable to confirm the start time for each individual case as this varies according to events on the particular day.

At the conclusion of a Hearing, the decision and the reasons are announced. The decision and reasons are also shared with the media and published below:

Please note that we don't operate under the principle that a decision made by in a particular case then means that all similar subsequent cases then automatically follow that decision. We carefully consider each and every case on its particular merits and make a decision as is seen fit in light of those particular merits.

Where there is a decision to remove a teacher's name from the register or to refuse an application for registration, the teacher has 28 days to appeal the decision to the Court of Session. During the 28 day period the teacher remains registered. Should an appeal be lodged, the teacher also remains registered until the Court of Session determines the outcome of the appeal, but in such circumstances, we may take steps to temporarily restrict the teacher at a Temporary Restriction Hearing.

If a teacher is removed from the Register, or an application for registration is refused as a result of a Fitness to Teach ruling, the individual concerned may apply for registration at the end of the time specified in the Fitness to Teach Panel decision which cannot be more than 24 months. Any such application will be considered by a Fitness to Teach Panel at a Subsequent Registration Application Hearing. An individual will only be permitted entry to the Register where a Fitness to Teach Panel is satisfied that he/she is now fit to teach.

Reprimand and/or Conditional Registration orders take immediate effect.
