Complaint

The complaint against the Respondent considered at the meeting was as follows:

  1. On dates not yet advised, at place not yet advised, you did form an inappropriate relationship with a pupil in your care.

Decision on Case to Answer

The Panel gave careful consideration to all the information that had been placed before it. The Panel noted that this matter had originally been the subject of a parental complaint to the school. The Panel noted the statement of the Headteacher who spoke to the Respondent admitting that she had formed a friendship with Pupil A after she had left school. The Panel also noted that the Headteacher spoke to seeing text messages between the two and being clear that it indicated the development of a relationship. The Panel noted that this was corroborated by the mother of the pupil who also spoke to having sight of the text messages and to noting that they commenced in June 2015 and were explicit in nature.

The Panel also noted that the Respondent accepted having kissed Pupil A in August and that again this was corroborated by the pupil’s parent. The Panel was satisfied that there was sufficient evidence to support the allegation.

The Panel noted that from discussions, the Respondent has intimated that she is seeking to remove her name from the Register on the basis of the following complaint:

  1. Between 18 June 2015 and 28 August 2015, both dates inclusive, whilst employed by XXXXXXXX as a Principal Teacher Pupil Support at XXXXXXXX School, you did form an inappropriate relationship with a female pupil (Pupil A) under your care and in particular you did:
    1. Send inappropriate communications by electronic means to Pupil A;
    2. Continue the relationship with Pupil A when Pupil A had left school in June 2015;
    3. Send sexually explicit text messages to Pupil A after Pupil A had left school in June 2015;
    4. and
    5. On 28 August 2015, you did kiss Pupil A.

The Panel agreed that it was appropriate in the circumstances to refer this matter to a Fitness to Teach Panel for the removal with consent process to be commenced. The Panel noted that behaviour of such a nature amounted to a gross abuse of her position of trust. The matter was aggravated as Pupil A was clearly a vulnerable young person and the Respondent had been in a promoted position and held a pupil support role in respect of Pupil A. The Panel indicated that such conduct would likely be found to be fundamentally incompatible with continuing registration.

Disposal

The Panel agreed to refer this matter to a Fitness to Teach Panel for the removal with consent process to be commenced.
