Remit (with delegated functions)
To hear cases relating to applicants for registration, re-registration and restoration to the register, and registered teachers involving:
The possible outcomes of a full hearing heard by the Disciplinary Sub-Committee are:
- make a finding of not guilty and take no further action
- impose no sanction
- issue a reprimand
- make a conditional registration order
- removal from the register
- mark on the register as suspended (the suspension is not a sanction but a temporary measure until the final disposal of the case is made. It means that the teacher can remain employed in their current post but cannot take up a new teaching post with any local authority)
- where the respondent is an applicant for registration, to direct that the respondent's application be refused or granted
- refer to Scottish Ministers for them to consider whether or not the respondent has harmed a child and his/her name should be included in the list of persons unsuitable to work with children under section 4 of the Protection of Children (Scotland) Act 2003 (does not apply to cases of serious incompetence).
The Disciplinary Sub-Committee also has the right to direct that a teacher’s registration be temporarily suspended.
